After much searching on sites for e46 e38 e39 all of which seems to have the same issue with the wipers i was less than sure of the sensor itself and as i had not got the inpa software mrm5. Originally the issue was the wipers would just get quicker and quicker in all conditions, even if it was barely raining. Thus current assumption is that the rain sensor part is faulty.
